NYC Transit “misled the jury” — and got busted.
In a Bronx trial, pediatrician Betty Luna, 44, claimed a bus on the Q44 route jerked violently when it took off after picking up her and other passengers in Jamaica, Queens.
Luna lost her grip on a pole, fell to the floor and suffered a torn minuscus.
NYC Transit put bus driver Angela Genussa on the witness stand. Genussa testified that the agency’s 1,677 hybrid buses were fitted with “acceleration-smoothing devices,” so Luna was a liar. But in cross-examination by Luna’s lawyer, Michael Gunzburg, Genussa admitted the gear was installed a year or two following Luna’s 2008 fall.
The jury awarded Luna $1.5 million. An NYC Transit spokesman would not comment on the case.
