Two Queens judges signed off on two search-warrant requests by the NYPD after an off-duty detective who shot a thug failed a sobriety test, sources said yesterday.
Detective Ivan Davison, 44, was initially placed on modified duty following the 2 a.m. Sunday shooting in St. Albans, Queens.
Stephon Allston allegedly fired three times at Davison with a TEC-9, while the detective squeezed off five shots, wounding him.
The department's Internal Affairs Bureau sought a search warrant when Davison refused to undergo further testing after failing the breath test.
The NYPD obtained a warrant from state Supreme Court Justice Deborah Stevens Modica to collect Davison's blood and Justice Toko Serita issued a search warrant for his car. Applications are routinely sealed, officials said.
Davison has been reinstated to full duty.
